User Agreement

Terms of service: an agreement between you and Think Pro to enter and use this website and services

Welcome to the Think Pro website and services.
We hope you enjoy your use of our facilities. Please appreciate and understand that this is a legal world and that you, by not immediately leaving this website now or immediately after reading our terms of service are accepting our services under the terms of this agreement.
It is your obligation to keep your self informed of any changes that may occur between visits, as using our services each time is under the condition that you accept all our terms and conditions. We may change our terms and conditions from time to time without expressly informing you.

1 Think Pro Services:
  • Create, design, customize products that are listed for sale.
  • Buy products that are listed for sale
  • Save and share designs that your may have created.
  • Use our fun picture and design tools.
  • Save created images and designs into public and personal galleries.
  • Post your created images to social networks or bloggs that you have the legal right to do so
  • Registering to subscribe to special offers and use of galleries.

2 Using our Think Pro Services and Website:
In consideration of the promises and obligations given and assumed herein, and intending to be legally bound, these Terms of Use provide as follows.


2.1 ELIGIBILITY CHILDREN UNDER 18.
Think Pro will only knowingly provide products or services to persons who can lawfully enter into and form contracts under applicable law.

If you are under the age of 18, but at least 13 years of age, you may order products or services only under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use.
Children under the age of 13 may view the Website but MAY NOT ORDER PRODUCTS OR SERVICES.



2.2 Definitions and Interpretation
In these Terms of Use, unless the context indicates a contrary intention:
  • Intellectual Property Rights means all industrial, commercial and intellectual property rights (including equivalent, neighbouring or proximate rights anywhere in the world that currently exist or are recognised in the future).
  • A person means any form of legal entity as well as any quasi-legal entity.
  • A User means any person using the website and/or services provided by Piki Print
  • A reference to any document, material, information or data includes that document, material, information and data howsoever stored, recorded or embodied, including in any electronic or digital media or otherwise.
  • The word includes in any form is not a word of limitation.


3 User's Obligations


3.1 Responsibilities
Users are and shall be wholly and exclusively responsible, at their own cost, for:
  1. all telecommunications lines, modems, communication controllers, routers, multiplexers, terminals and all other equipment, hardware and software necessary to access and use the Website and services;
  2. the use that it makes of the Website , including any article, material, literary or artistic work, design or other matter that they author, invent, create, develop or produce;
  3. complying with all laws, regulations and rules in the uses country or jurisdiction;
  4. complying with any recommendations or guidelines issued by Think Pro with respect to the use of the Website and/or services and
  5. ensuring that all electronic or other media it uses in connection or in conjunction with the Website and the services provided complies with these Terms of Use and all applicable laws, regulations and rules.


3.2 Restrictions on Users
Users shall not and has no right to either:
  1. reproduce, publish, distribute, sub-license and/or resell either the Website and/or service to any person; or
  2. use either the Website to supply any service to any person; or
  3. modify, adapt, disassemble, recompile and/or reverse engineer either the Website or service;
  4. access or use either the Website and/or service to create, author, design, manufacture, market, publish, transmit, broadcast, distribute or sell any article, product, material or other matter that either:
    1. infringes the rights of any person, including, without limitation, Intellectual Property Rights, trade secrets, rights of privacy and publicity.
    2. is libellous, defamatory or slanderous,
    3. condones, promotes, contains or links to adware, cracks, hacks or similar utilities or programs,
    4. contains explicit sexual content,
    5. does or may denigrate or offend any ethnic, racial, gender, religious or other group, through use of language, images, stereotypical depiction or otherwise,
    6. is designed to or does harass, threaten, defame or abuse others,
    7. exploits images or the likeness of minors,
    8. encourages the use of drugs or the under-age use of alcohol or cigarettes, or
    9. is generally offensive or in bad taste;
  5. use "Spam", "blast-faxes" or recorded telephone messages to market or sell any products or services,
  6. use, transfer or implant a virus, routine or any computer program or technology that disrupts, disables, interferes with or otherwise has a detrimental affect on the Website and/or the PIKIWARE® Platform,
  7. take any action that imposes any unreasonable or disproportionately large load on the Website or the Service,
  8. use a robot, spider or other device or process to monitor the activity on or copy pages from the Website or the Service,
  9. collect electronic mail addresses or other information from our Website,
  10. impersonate another person or entity,
  11. engage in any activity that interferes with any persons ability to use or access the Website and/or services, or
  12. assist, procure or aid any person to engage in any activity prohibited by these Terms of Use; or
  13. frame or link or otherwise use or display the Website in such a manner so that it appears to be part of its own or someone else's website, without specific agreement.

USER ACKNOWLEDGES AND AGREES THAT Think Pro MAY IN ITS SOLE AND UNFETTERED DISCRETION, UNILATERALLY AND WITHOUT NOTICE, TERMINATE THESE TERMS OF USE, DISABLE AND DENY ACCESS TO THE USER TO THE WEBSITE AND THE SERVICES, AND TAKE LEGAL ACTION AGAINST ANY USER WHO ENGAGES IN ANY ACTIVITY OR CONDUCT THAT IS PROHIBITED BY THESE TERMS OF USE AND/OR BY ANY RELEVANT LAW, REGULATION OR RULE.

4. Think Pro Obligations

4.1 Access to and use of the Website and Services Subject to user complying with and discharging each of its obligations under these Terms of Use, Think Pro shall allow user to access and use the Website and the services .

4.2 Privacy: Think Pro may collect personal data concerning the user in the course of and incidental to users use of the Website and services. Think Pro shall comply with, and user hereby consents irrevocably and unconditionally to Think Pros collection, use and disclosure of such data in accordance with, its Privacy Policy (the terms of which may be accessed through the link on the Website).

4.3 Training
User acknowledges that Think Pro has no obligation to user to provide any training or other support in relation to the use or operation of the Website and/or services.

4.4 Modification of the Website.
Think Pro reserves the right to modify the organization, structure, content or "look and feel" of the Website and/or the services, and may change, suspend, or discontinue any aspect of the Website and/or the service at any time without notice or any liability to user or any person. Think Pro shall have complete discretion over the features, functions and other terms and conditions on which the Website and the service is made available.


5. Intellectual Property Rights

5.1 Reservation of title
user acknowledges that these Terms of Use do not convey and that it derives no right, title or interest in or to any Intellectual Property Rights that vest or subsist in or relate to the Website and/or the services provided other than pursuant to the express authorisation set out in clause 4.1. Think Pro grants user a limited revocable licence to access and use the Website and the service for its intended purposes, subject to users compliance with these Terms of Use. This licence does not include the right to collect or use information contained on the Website for purposes prohibited by Think Pro; to compete with Piki Print; to create derivative works based on the layout or design, look-and-feel, or structure of the Website; or download or copy the Website (other than page caching). If user uses the Website in a manner that exceeds the scope of this licence or if it breaches these Terms of Use, Think Pro may revoke the licence and deny access to and use of the Website.

5.2 Prohibition on infringement
User acknowledges and agrees that Think Pro does not permit, authorise or condone and hereby expressly prohibits user from accessing or using the Website and/or the services in a manner that infringes, or is likely to infringe, the Intellectual Property Rights, or any other rights or privileges, of any person anywhere in the world.

5.3 Derivative material
Subject to clause 5.2, user shall own any Intellectual Property Rights in any original material that it authors, designs or creates using the functionality provided by the Website. If the user chooses to add any item to a public gallery, In consideration of the authorisation granted under clause 4.1, User hereby grants to Think Pro an irrevocable, perpetual, non-exclusive, world-wide licence to do all acts and things (including to authorise other persons to do all acts and things) comprised within the said Intellectual Property Rights.


6. Registration

User Account, Password, and Security You will receive a password and account designation upon completing the Site's registration process. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify Think Pro of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. Think Pro cannot and will not be liable for any loss or damage arising from your failure to comply with this Section 6.


7. Warranties


7.1 Users warranties
User represents and warrants to Think Pro that, in its use of the Website and the Services provided, it:
  1. will not infringe the Intellectual Property Rights, trade secrets, rights of privacy, rights of publicity or other legal right of any person, and
  2. will comply with all applicable laws, rules, and regulations.
  3. User further represents and warrants to Think Pro that:
  4. there are no claims, demands or any form of litigation pending, or to the best of its knowledge, threatened with respect to any content used or proposed to be used by user;
  5. Think Pro will not be required to make any payments or compensation to any person in connection with its use of such content; and
  6. such content does not contain viruses or any other programs or technology which disrupts or damages the Website and/or the Services provided.


7.2 Think Pros warranties
Think Pro represents and warrants that it has the right to grant access to and license the use of the Website and services to user subject to and in accordance with these Terms of Use.

7.3 Caveats
  • Think Pro provides the Website and Services on an "as is" and "as available" basis. Nothing in these Terms of Use shall or may be construed as a representation or warranty by Think Pro that the functionality or operation of the Website and/or the services will:
    1. be uninterrupted or free of errors and inaccuracies;
    2. meet users requirements; or
    3. operate in the configuration or with the hardware or software used by user.
  • User acknowledges and agrees that the Website and the service (as with technology generally), may have errors (or bugs) and may encounter unexpected problems. Accordingly, user may experience downtime and errors in the use or operation of the Website and/or services provided.
  • Think Pro does not and cannot control the flow of data and information through the internet, and such flow depends on the performance of persons and entities whose actions or inactions may produce situations in which connections to the internet (or portions thereof) are impaired or disrupted and for which Think Pro is not liable.
  • Think Pro does not warrant that any data, information or other content provided on the Website, whether concerning any goods or services or any other subject, is complete or accurate.


7.4 Exclusion of implied warranties
SUBJECT ONLY TO CLAUSE 8.1, ALL CONDITIONS, WARRANTIES, REPRESENTATIONS, INDEMNITIES AND GUARANTEES WITH RESPECT TO THE WEBSITE AND/OR ANY OTHER GOODS OR SERVICES THAT MAY BE PROVIDED BY Think Pro, THAT WOULD OTHERWISE BE IMPLIED BY STATUTE, LAW, EQUITY, TRADE CUSTOM, PRIOR DEALINGS BETWEEN THE PARTIES OR OTHERWISE (INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, SUITABILITY, FITNESS FOR PURPOSE, QUIET ENJOYMENT OR NON-INFRINGEMENT) ARE HEREBY EXPRESSLY EXCLUDED.

7.5 No representation or reliance
(a) User acknowledges that neither Think Pro nor any person acting on Piki Prints behalf has made any representation or other inducement to user to enter into these Terms of Use, except for representations or inducements expressly set out in these Terms of Use.
(b) User acknowledges and confirms that it does not enter into these Terms of Use in reliance on any representation or other inducement by or on behalf of Think Pro, except for representations or inducements expressly set out in these Terms of Use.


8. Exclusion and Limitation of Liability

8.1 Subject to law
Nothing contained in these Terms of Use excludes, restricts, limits or modifies any:
(a) implied condition, warranty or other term of these Terms of Use where pursuant to applicable law to do so is unlawful or void; or
(b) liability in respect of a breach of these Terms of Use where pursuant to applicable law to do so is unlawful or void; or
(c) liability for fraud or deceit; or
(d) liability for death or personal injury caused by the negligence of either party.

8.2 Exclusion of liability
Subject only to Clause 8.1, in no event shall Think Pro be liable to user or to any person under or in connection with these Terms of Use or in respect of the use of (or failure or performance of) the Website and/or the services provided for:
(a) malfunctions, failures, defects, acts or omissions or any other default or liability caused directly or indirectly by:
  1. any third party;
  2. actions of user that were not expressly authorised by Think Pro;
  3. accident, misuse or abuse by anyone other than Think Pro;
  4. alteration or modification of the Website and/or the service, or any component or part of the Website and/or the service provided, by anyone other than Think Pro;
  5. products (including any hardware or software) or services not licensed or supplied by Think Pro;
  6. power surge or failure,
  7. events of force majeure or events outside Think Pros actual control; or
  8. any other condition not arising under normal operating conditions;

(b) any loss, cost, damage or expense of any nature arising or caused directly or indirectly by any breach of users obligations or responsibilities set out in these Terms of Use;
(c) any loss of profit, business interruption, loss of or damage to goodwill, and/or any expectation benefit;
(d) Subscribers liability to any person; or
(e) incidental, indirect, consequential, special, exemplary or punitive damages of any nature, whether such liability is asserted on the basis of common or civil law or in equity, including pursuant to any statute, contract, tort (including negligence or strict liability) or otherwise and notwithstanding that Think Pro has been advised of the possibility of any particular loss or damage.

8.3 Links
Think Pro may, in its sole and unfettered discretion, and without users consent, place links on the Website to other websites that are owned or operated by other persons. User acknowledges and agrees that Think Pro is not responsible for the operation of or content located on any such website, and Think Pro cannot and does not warrant that the content of such websites is accurate, complete, legal and/or inoffensive. By choosing to link to these other websites, user acknowledges and agrees that it may not make any claim against Think Pro for any damages or losses of any kind arising from the other website and/or the link.

8.4 Limitation of liability
Subject to Clause 8.1, and except to the extent specifically excluded under Clause 8.2 or elsewhere in these Terms of Use, Think Pro's sole liability to Subscriber for any and all breaches of any term or terms of these Terms of Use, whether express or implied, shall be limited to the substitution or replacement of any product or service that has been ordered and paid for by Subscriber using the Website.

8.5 Indemnity User shall indemnify and hereby releases unconditionally Think Pro , without set off or adjustment, against and from any liability, loss, cost, expense or damage, including all legal fees, arising from or relating to: (a) its use of the Website and/or services and/or the media or content posted or uploaded by it, including any alleged or actual violation of any law directly or indirectly arising from such use; (b) any breach or alleged breach by it of these Terms of Use; (c) the misuse or misappropriation of the said media or content; and (d) any infringement or alleged infringement by user of any persons Intellectual Property Rights, rights of privacy or publication, or otherwise anywhere in the world.


9. Termination

9.1 Termination
(a) At any time and with or without cause, Think Pro may immediately terminate either these Terms of Use or any or all rights and privileges granted to user hereunder, including suspending users access to and/or use of the Website and/or the Services provided by Think Pro. In no event shall any such termination or suspension by Think Pro relieve user of any obligation that has accrued under these Terms of Use prior to the date of such termination or suspension.
(b) user may terminate these Terms of Use at any time by ceasing to enter the website and using the services

9.2 Effect of termination
(a) On any expiry or termination of these Terms of Use, Think Pro may delete any websites, web pages, files, graphics, media or other content or material relating to users use of the Website and/or the Services provided and Think Pro shall have no liability to user or any person for doing so.
(b) The expiry or termination of these Terms of Use shall not prejudice or affect any cause of action, right, remedy or defence which shall have accrued or shall thereafter accrue to either party.


10. General

10.1 Severability
If a clause or any part of any clause of these Terms of Use or a right or remedy of a party under these Terms of Use, is found to be void, invalid or unenforceable by any court or tribunal having jurisdiction in respect of these Terms of Use, then:
(a) it shall be read down or severed in that jurisdiction only to the extent that it is void, invalid or unenforceable; and
(b) it does not effect the validity or enforceability of that term or clause in another jurisdiction or the remaining terms or clauses in any jurisdiction.

10.2 Variation
Think Pro may amend unilaterally these Terms of Use in its sole and unfettered discretion at any time, and user hereby agrees to abide by and be fully bound by such amended terms. The amended terms shall be effective automatically and immediately once they are posted on the Website, and user's continued access and use of the Website and the Services on or after such effective time constitutes the user's unequivocal and unconditional acceptance of the amended terms. These Terms of Use may not be otherwise amended. If user does not agree to any amendments to these Terms of Use or to any of the current terms, its only right and remedy is to cease using the Website and the Think Pro services.

10.3 Waiver
A waiver, consent, election or acquiescence given by a party under these Terms of Use is only effective and binding on that party if it is given or confirmed in writing by that party.

10.4 Assignment
(a) Think Pro may at any time transfer, assign, novate or otherwise dispose of any or all of its rights or obligations under these Terms of Use on giving user no less than five (5) days notice in writing.

10.5 Governing Law and Jurisdiction
(a) These Terms of Use shall be governed by and construed in accordance with the law in force for the time being in Delaware, United States of America (without regard to its conflict of law rules).
(b) Each party irrevocably submits to the exclusive jurisdiction of the courts of Delaware, and the courts competent to determine appeals from those courts, with respect to any proceedings that may be brought at any time relating to these.

Terms & Conditions

 

Turnaround Time

Our standard turnaround time is 5-7 business days from the time that you remit payment and approve proofs for your order, and is subject to change based on the current production schedule. The term “standard turnaround” refers to orders which are our standard prints and don’t include additional services on the order. Some of our services and printing methods may add to the standard turnaround time. Please view each add-on service on our website for the latest turnaround time for each service. If you have a specific deadline (see In-Hands Date below) that you need to have met, please notify us when placing your order. Taking more than 24 hours to approve your order will add to your turnaround time. Rush fees may apply to orders needing a quicker turnaround time than what our standard turnaround time offers. Think will not be held responsible for missing deadlines due to weather conditions, power supply interruptions, vendor shortages and errors, shipping errors, or any acts of God. If we expect or foresee any problems in advanced, we will be sure to notify you and work with you to rectify them.

 

Turnaround Time Example

Let’s say you're placing an order on American Apparel TR401’s (nice pick!), getting custom printed tags added onto your shirts and the manufacturer labels removed. If the standard turnaround time is 7 business days for printing, +1 day for custom printed tags, +2 days to remove the standard manufacturer label, you would be looking at 10 business days for your turnaround time on this particular order. Keep in mind that this does not include shipping time.

Mixed Processes

Let's say you're placing an order for 100 shirts, getting screen printed art on the chest and embroidery on the sleeve. While the standard turnaround for screen print is 5-7 business days, our turnaround time for embroidery is 7-10 business days. Because we always complete one process before starting the next one, the business days for screen print and embroidery do not occur simultaneously. You should assume an order in this case may be completed in 12-17 business days, not including time for shipping.

 

Payment Terms

Due In Full: ­Payment is due in full to start production, however, no payment is required until you approve your digitial mockup.

Net Terms: ­Orders with Net Terms (i.e. Net 15 or Net 30) can simply approve the order without payment up front. The invoice date and Net Term’s start date is generally the day your order is shipped. A final invoice will be emailed to you. Orders with Net Terms must be paid with cash, check or money order; credit cards and PayPal are not accepted for Net Terms orders. (See Invoiced Quantity below for a complete look at how the final invoice balance is determined.)

 

Under/Over Run Allowance

Custom printing is an artform, especially when it comes to water based and discharge inks. We do our very best to deliver, at minimum, the ordered quantity for each and every size on your order. However, printing mistakes happen, screens break on press, shirts arrive with holes or stains from the manufacturer. For that reason, we have an under/over run allowance. This is simply an acceptable margin of error.

All orders within the Under/Over Run Allowance of the ordered quantity will be considered acceptable for delivery. For this reason, we highly recommend you order extra garments for each size. Think will not be responsible for profit loss on under runs. If requested, in the event of an underrun greater than our Under/Over Run Allowance, we will reprint the remaining quantity.

  • Standard & Oversize: 5%

  • Jumbo: 10%

Under/Over Run Allowance on Contract Orders is calculated by number of impressions on the order, not the number of pieces.

 

Invoiced Quantity On Net Terms

IMPORTANT: Your final invoice will reflect the total quantity shipped. This total quantity will be within the Under/Over Run Allowance for your order. This means that if you order 100 oversize prints, your order will show 100 pieces, but your final Invoice after production could show an invoiced quantity between 95 and 105 pieces. This is the Under/Over Run Allowance for that order (5%). The price per piece will not change from the Order to the Invoice.

 

Rush Orders

Orders that require an in-hands date sooner than our standard turnaround time (per the order specs and services) are subject to rush fees. Below is the rush fee percentage schedule which indicates the percentage amount to be added to the order total, based on how many days are being cut out of our specified turnaround time. Rush orders still incur the same limitations as outlined in the turnaround time above. So, if a rush order needs an in-hands date 3 days earlier than our standard turnaround time for your order, 30% of the total order will be added as a rush fee.

  • 1 Day: 10%

  • 2 Days: 20%

  • 3 Days: 30%

  • 4 Days: 40%

  • 5 Days: 50%

  • 6 Days: 60%

  • 7 Days: 70%

  • 8 Days: 80%

  • 9 Days: 90%

  • 10 Days: 100%

Rush Orders are subject to the same Under/Over Run Allowance as standard orders. Rush time frames are based on our current production schedule and do not include shipping time. Think will not be held responsible for shipping issues once your order has left our facility.

 

Artwork

 

Artwork Creation & Ownership

All artwork created by Think is the sole property of Think. If you hire us to create artwork for you, you are strictly paying for the labor and thought process to produce the artwork. You are not paying for the ownership and rights of the artwork. Rights to the artwork can be purchased in addition to the creation fees.

Any artwork you submit to us for printing, that is not being created by Think, is owned by you or its rightful owner, not Think. We will not reproduce your artwork, trademarked or not, without you or the rightful owner’s consent.

 

Art Preparation

Art not supplied in print ready format, as specified in our File Prep section, is subject to be billed at our current rate. We will always give you an estimate before doing this work. Any art preparation done is the property of Think. For example, if you supply artwork for your order which incurs a $150 charge for separations on your 6 color simulated process print, you do not own the separated art file. That separated file is the property of Think, although the artwork itself, is still your property.

 

Art Approval

All artwork must be approved online. Upon receiving your initial mockup, you will be allowed one additional set of revisions free of charge. Any additional revisions past that point will incur an additional Art Preparation fee to be billed at our current rate. Changes to the artwork after approving the mockup could push back your ship date. We will not be responsible for errors, misspelling, or otherwise in approved digital mockups and artwork.

 

Garments, Blanks, Shirts & Pieces

 

Out of Stock Items

Think will not be responsible for items that are out of stock. All purchasing of product is done on an order by order basis. Very few goods are stocked at our facilities. We do our best to provide you with an accurate inventory prior to your order being placed, but we cannot “hold” goods from the time you receive a quote to the time you actually place the order. Should items become out of stock, we will do our best to find a replacement and get it approved by you prior to using it for your order.

 

Manufacturer Defects

Think is not responsible for manufacturer defects such as garment color inconsistencies, mislabeled sizes, loose stitching, label inconsistencies, or other garment defects. We do our best to inspect the garments as they are printed, but we cannot guarantee each garment. We highly recommend ordering 5% extra of each size to avoid the possibility of the aforementioned issues.

 

Garment Subjectivity

Think will not be responsible for you not liking the garment printed on or the printed artwork. We do our very best to make sure you have selected a garment that you will expect and matches your needs, but we also expect you to do some research on your own. We do our best to provide garment size specs for each product listed on our website. If size specs are not listed on our site, we recommend you confirm and verify them on the manufacturers' site to ensure the garment is going to fit as you intend. If there's any doubt about whether you'll like the selected garment, we recommend ordering a blank sample first. Please keep in mind that ordering blank samples will push back the turnaround time. Blank samples are available for purchase, but are not refundable or transferable towards a full production run.

 

Printing

 

Customer Provided Garments

 

Additional Cost and Counting

We expect your items to be counted, boxed, and organized by design and sizing. Quantities should be clearly notated - If there is a discrepency between the order quantity and the quantity provided, the order will be placed on hold until clarification is received. Items should be debagged with any stickers or tags removed so the printing process is uninterrupted. THINK will apply a $60/hr debagging fee to orders that do not meet this requirement.

Garment Condition

To prevent issues or delays with the printing process, all customer provided garments must be unworn and unwashed. THINK reserves the right to refuse any garments that do not meet this requirement.

Non-Standard Garments

Non-standard garments include any garment that requires altering the standard print process to accommodate printing. Some examples may include baby-onesies, dresses, some styles of bags, socks, jackets/hoodies with multiple layers, pillowcases, etc. THINK cannot be held responsible for any issues caused by these garments during the print process. If there are any concerns about possible issues with your garments, please provide extra garments for testing so your final total is unaffected.

Spoilage Policy

THINK allows for 5% spoilage with customer provided garments. If order spoilage falls within this 5%, we will consider these garments waste and you will not be charged for the printing of the spoiled garments. We recommend providing us with extra garments for testing if there are concerns about print quality. We will offer a reprint for spoiled garments that fall within this policy at no cost if you provide replacement garments.

 

Minimums

For the most accurate print minimums, please refer to the specific service pages on our website.

 

Image Sizes

All shirt sizes in an order will be printed with the same image size unless otherwise requested. Different image sizes being printed on different shirt sizes will be treated as a new order and priced as such. An image size printed within 1 inch of any seam is subject to distortion, print imperfections, and/or other small inconsistencies. These are all considered acceptable goods. We will not assume responsibility for print imperfections due to printing too closely to seams.

 

Seam, Collar and Zipper Printing

We do our very best to produce the best looking prints any time we pull a squeegee. However, printing on or over any seams, collars, pockets, zippers or otherwise is subject to distortion, print imperfections, and/or other small inconsistencies. These are all considered acceptable goods and will not be considered misprints.

 

Wash Down

Since water based and discharge inks actually dye fabric and are not plastic inks sitting on top of the shirt, we will not be responsible for fading or weathering of goods. Once a print leaves our facility, we are not in control of the elements a print will endure, such as wash temperature, abrasiveness, soaps and chemicals, etc. and therefore can not guarantee the wash down and weathering of the product.

We print with the highest quality products and equipment available for water based and discharge ink and have scores of ecstatic clients because of such. We take great pride in the quality of our work. That being said, very small amounts of washdown on ink colors should be expected with each additional wash since fabric will fade with additional washing.

 

Care Instructions

In order to ensure image longevity and vibrancy, we recommend machine wash cold, tumble dry low for all water based and discharge ink prints. Foil prints should be washing inside out and line dried. All goods should be washed before wearing, especially all­over prints.

 

Hand

Prior to a first wash, it is completely normal to feel a slight “hand” with discharge ink on the shirt. Once the shirt has been washed, this feeling generally goes away and the hand is very soft and smooth. If specialty or high opacity inks are requested, the hand can vary and be more apparent.

 

Image Placement

We will do everything we can to ensure images are printed in a consistent location on all garments within a run. However, small variations should be expected. For example, if a request is made for an image to be printed 2" below the bottom of a collar, a 3/4" standard deviation in either direction will be considered acceptable. If a request is made for images to be printed near the tag area on the back of the shirt and directly over the tag, it could have small ink coverage inconsistencies and will be considered acceptable.

 

Reorder Ink Color

Due to the nature of water based and discharge ink and different fabric lots, we cannot guarantee exact ink color matches on reorders. We will make every effort to match the original color as best as possible. If you know a reorder will be likely, please let us know and we’ll try to keep ink on hand if at all possible.

 

Ink Color & Pantone Matching

Due to the nature of water based and discharge inks, we cannot guarantee requested Pantone colors. Our standard ink color list has approximate Pantone values listed with most colors. This value may or may not be used in the mockup provided. We cannot guarantee ink colors based on visual mockups alone. We recommend checking the colors given against a Pantone book. Monitors can vary significantly from one computer to the next. Please check a Pantone book for color accuracy. Pantone books can be purchased from Amazon.com.

 

Ink Color Change Minimums

Orders are allowed changes of up to 2 ink colors on 1 location at 1 time. After this, all additional ink color changes will become a new order.

 

Style Change Minimums

Garment style or garment color changes are allowed as long as the minimum order quantity for that particular order is reached.

 

Samples

 

Printed Sample Policy

Printed Samples are available with the following pricing and terms:

  • $50 per a color per location plus the retail value of each garment for screen printed items, and 2X the normal cost for DTG prints plus the retail value of each garment.

  • $65 for each pantone match

If artwork needs to be separated, created, or touched up, it will be subject to art charges at the current rate.

 

Additional locations are considered additional colors.

You will receive three physical, printed samples. If artwork needs to be separated, created, or touched up, it will be subject to art charges at the current rate. Art does not count towards the sample order value for credit purposes and will not be credited back towards the full production run.

A complete credit of the sample cost is available if an order for the full production run is placed within 10 business days of the sample shipping out of Think’s facility or being available for pick up. In order to receive full credit, the art must stay exactly the same, thus using the same screens. To receive 100% credit, the sample order value must be less than 10% of the full production run’s order value.

For example, if you ordered an oversize 3/0 sample, the cost would be $200 ($100 + $50 + $50). To receive a full $200 credit, the full production run must have a value of at least $2000 (excluding art, shipping, and ink changes).

Pantone Matching fees do apply on sample runs. They do not count towards the sample order value in terms of credit on the re­order, nor will they be credited back onto the full production run.

For example, if someone ordered a $100 sample which had one Pantone Match, the total would then be $120 ($100 + $20). The full production run total only needs to be $1000 to get the full $100 credited back. It does NOT need to be $1200 to receive the credit. The $20 Pantone Match will NOT be credit back onto the full production run. Hoodies and other certain sample pieces could be an additional charge.

 

Packaging, Shipping, & Receiving

 

In-Hands Date

If you have a specific deadline (in-hands date) for your order that is sooner than what our standard turnaround time would deliver, please notify your Account Executive immediately. Orders needed sooner than our standard turnaround time for your order may incur a rush fee.

 

Shipping

We ship via UPS & FedEx. To view normal transit times, see our shipping map. A tracking number will be sent to you shortly after your order has left our facility. Think will not be responsible for shipping transit complications for any reason such as errors, weather, strikes, or otherwise. Shipping time is not included in our turnaround times. Shipping expenses are the sole responsibility of the client and will be added to your invoice unless otherwise agreed upon prior to your order. Shipping costs are not normally included on quotes. Think assumes no responsibility for goods once they have left our facility. We will not be responsible for shipping to a wrong address if it was listed on your quote and you failed to correct the address upon quote approval.

 

Split Shipping

We are happy to split ship your order. Shipments will be billed at current rates. Please send an itemized list detailing what quantities should be shipped to what address when placing your order. Split shipping changes after the order is submitted may result in additional charges.

 

Packaging

All orders will be bulk packaged, generally folded by the dozen, unless stated otherwise.

 

Checking Your Order

Please check your order and notify us of any problems within 72 hours of delivery. We will not be responsible for error orders after 72 hours.

 

Contract Orders

 

Custom vs Contract Orders

We define custom orders as orders in which we’re procuring the blank garments. If you want to supply the blanks, the order type is now a Contract Order and subject to some slightly different policies and guidelines. Most policies and guidelines outlined on this page are in reference to Custom Orders, although apply to Contract orders as well. A few policies which are different would be Under/Over Run Allowance calculations, in which we have a 10% under allowance per location being printed.

Contract Order Garments

We request an itemized list of each style, color, size, and quantity being delivered. We will check ­in the delivered quantity with the stated order quantity to ensure the proper amount has been received. Not providing a receiving summary is subject to a confirmation fee of $25/100 pieces. Orders shipped unsorted or mixed with other orders are subject to sorting fees of $75/hour, $25 minimum/order. We will not be responsible for shortages.

 

Miscellaneous

 

Removing Manufacturer Tags/Labels

If you are having us print custom tags in your shirts, please be aware that the stock tags will be removed. By default, this service fee and turnaround time will be added to your order (please see below for tear-away tag policy). Please be sure to inform us if you want the stock tags left in the garments along with the new custom printed tag.

 

Removing Tear-away Tags/Labels

If your shirts come with tear-away tags, we will tear those out free of charge. Please be aware that tear-away tags may leave small pieces of the tag in the shirt seam. Unless you have paid for tag removal service, we are not responsible for removing all pieces of the tag, should some remain in the seam. If you want them unsewn for removal, thus eliminating the chance of the tear-away remnants, standard manufacturer tag removal fees and turnaround time will apply.

 

Blank Apparel Orders

If you choose to order "Blank Apparel" before placing your full production run, at a minimum of 20 pieces at full retail costs.

 

Social Sharing

We enjoy showing off your product and our craft to the world. It’s a great way to showcase our skills and send some of our followers and fans your way as well. We do this by taking photos and posting them online via social platforms, such as, but not limited to, Instagram, Facebook, Twitter, and Google+. Please be sure to notify your Account Executive when placing your order if you are not comfortable with us photographing and sharing your shirt socially. If you do not notify us, we will assume that we have your full permission to post photos of your shirt(s) online.

 

Quotes & Estimates

Quotes, or estimates, are good for 30 days unless stated otherwise. This term is subject to seeing final artwork to confirm any quotes. Final invoices will reflect the quantity shipped, not the quantity quoted (see Invoiced Quantity).

 

Physical Print Pictures

Digital photos acting as proofs of the shirt being printed are available for $50 per location. A two hour window will be given by Think for an approximate digital proof time. Once the proof is sent to the client from Think, the client will have 15 minutes to approve. If we don’t hear from you within 15 minutes, the order will be taken off press and subject to a re setup fee of $50/color/location. If additional time is needed over and above the first 15 minutes to approve of the digital photo proof, you will be billed in 15 minute increments at $100 per increment.

 

Guarantee

We fully stand behind our work. If for any reason we make a mistake printing your order and it is not what was agreed upon and falls outside of these Print Policies & Guidelines, we will gladly reprint your order within 10 business days. We do not offer refunds.

 

Credit Terms

If credit terms are desired, please contact us for a credit application. Your application will be reviewed and you will be notified within 7 business days.

 

Finance Charges

Any orders that are late on payment by 10 days or more will incur interest of 1.5% per month dating back to the invoice date. A $50 late fee will also be added to the invoice.

 

Cancellation

Orders that are cancelled prior to printing will be subject to a Cancellation Fee based on the total order value. Cancellations will not be accepted once shirts have been printed. Cancellation fees are as follows:

  • Within 4 days of placing your order: 15% Cancellation Fee

  • After 4 days but at least 5 days before the est. ship date: 75% Cancellation Fee

  • Within 5 days of the est. ship date: 100% Cancellation Fee

 

Returned Checks

There is a $30 charge for returned checks. The subsequent payment must be made with cash or a cashiers check.

 

Terms & Conditions

Print Policies & Guidelines may also be referred to as Terms & Conditions and vice-versa. Think reserves the right to change its Terms & Conditions at any time without notice.

Think will observe the following holidays for the year 2016 & 2017. These days will not count as production days towards turnaround times.
